LMEA EXECUTIVE COUNCIL MEETING MINUTES
September 12, 2016

President C. Santa Maria called the meeting to order at 4:09 pm.

Officer’s Reports:

President’s Report: After welcoming new council members and reps to a new school year, C. Santa Maria gave the following report:

Please check the list of building reps and exec council members and make sure it reflects the most up-to-date information. If it doesn’t, make sure you check in with Arlene. Future meetings, for the short term (October through December) will take place at the Academy building on the BCMS property.

Since this is a bargaining year, we will hold informational meetings at each building location. Dates will be published in the October Apple Core.

You may have heard that LMSD lost in court to a plaintiff who was seeking an injunction to prevent the tax increase. The judge ruled the district had increased taxes in violation of tax laws, based on the district’s growing fund balance, which accumulates as a result of spending less than was budgeted on an annual basis. While a fund balance is in most cases a sign of sound fiscal policy and responsible management, the plaintiff in this case adopted the position that because public schools are supposed to only provide a basic educational program, the fund balance was tantamount to a practice of reserving funds that rightfully belong to taxpayers. The judge agreed and ordered the district to return to taxpayers monies paid for the current school year by reducing the tax increase from 4.44% to no higher than 2.4%. Further, the court will leave “for another day” the question of rebates for taxes already paid, which could add up to a total of more than $47 million. The district has filed an appeal, and the PSEA will join the district in opposing the ruling. Resolution will not be quick—it could take several months—but the presence of the issue will be a factor in our bargaining process. Treasurer: D. Mandarino made a motion to accept the June, July, and August Treasurer’s Reports—passed.

Committee Reports:

Outreach: J. Mudd reported ongoing work on Linda’s campaign.

Constitution: M. Stettner reported that we’ll be revising our document for the first time in years.

Elections: A. Flicker reported that we will be electing delegates to the PA House of Delegates at the regularly scheduled General Membership meeting on October 13. The meeting will take place at the LMEA office.

CIPD: The first meeting of the year is September 28.

CNC: Our first meeting will be Tuesday, September 20.

FAC: NO REPORT

Health & Safety: Our first meeting is September 22—please send concerns to Larry or Aimee.

Legislation: The work is just beginning in Harrisburg.

Minority Affairs: NO REPORT

PACE: M. Stettner reported that continuous contributors don’t need to do anything to maintain their deductions as in the past; new members or non-continuous contributors should see their building reps.

PR&R: P. Dawson reported on the grievances ongoing from last year. We have an arbitration coming up this week and we look forward to the outcome.

Social: NO REPORT

Special Services: NO REPORT

Membership: D. Grumbine submitted a written report, which is accurate as of the most recent Board Report.

CARE: NO REPORT

Education Foundation: D. Simon reported that on October 24, the Harlem Wizards will again take on a faculty team in our annual fundraiser. We would like two players from each school—please contact Danita Simon if you’re interested in playing. We also need workers for concessions, tickets sales, and ushers, too. Tickets are $8 and the LMEA is a sponsor of this event.
